Kennedy is Associate Professor in the Indiana University School of Public and Environmental Affairs (SPEA) on the IUPUI Campus, where she joined the faulty in 1998. A cum laude graduate of the law school, Kennedy served as Executive Director of the Indiana Civil Liberties Union from 1992- 1998. She has also worked as President of Kennedy Development Services, as a partner in Mears Crawford Kennedy & Eichholtz, Corporate Counsel of the City of Indianapolis and an associate attorney at Baker & Daniels. Kennedy also ran as a republican candiate for the 11th Congressional District in 1980.
She is an active member of the Indiana State Bar Association, Indiana Leadership Celebration, American Political Science Association, Midwest Political Science Association, Academy of Political Science, American Society for Public Administration, Indiana Society for Public Administration, Law & Society Association, Society of Professional Journalists, Association for Public Policy Analysis and Management, Association for Research on Nonprofit Organizations and Voluntary Action, Standing Panel on Social Equity, National Academy of Public Administration.
Her fields of expertise include Charitable Choice, Civil Liberties/Civil Rights, Religion and Public Policy, Nonprofit organizations. She is the author of numerous books and chapters, including her most recent work, God and Country: America in Red and Blue (Baylor University Press, 2007).

Campaign advisers to U.S. Sen. Barack Obama’s campaign will talk to students at IUPUI Wednesday about Obama’s plans to create green jobs, ensure energy security and fight for clean air and water.
Environmental Law Students at Indiana University’s Law School in Indianapolis will host Obama advisers Cameron Davis and Jack Darin at IUPUI’s new Campus Center. They will be joined by State Representative and Chair of the Indiana House Environmental Affairs Committee Ryan Dvorak. Professor Eric Dannenmaier, who teaches environmental law at IU’s Law School, will moderate.
Davis, who is the president and CEO of the Alliance for the Great Lakes*, and Darin, an influential environmental leader in Illinois who worked with Obama when he was a state senator, have been long-time advisors to Obama and his campaign on environmental and energy issues, and they know his deep concern for finding the right balance in this vital policy area.

Background on Speakers
Cameron Davis is President and CEO of the Alliance for the Great Lakes.* He is a nationally-recognized expert on water quantity and quality issues and served as a policy advocate and litigator with the National Wildlife Federation while serving as adjunct clinical assistant professor of law at the University of Michigan Law School. Cam also served with the United Nations Environment Programme in Nairobi, Kenya, and U.S. EPA’s Office of Regional Counsel in Chicago.
Jack Darin has worked in the environmental movement since 1989 and has worked cooperatively with a wide range of stakeholders to clean up pollution, protect natural areas for future generations, and to promote smart energy policies. He has been appointed to numerous study, advisory, and working groups and task forces by various public agencies seeking to craft strategies to protect the environment.
Ryan Dvorak represents Indiana’s 8th House District in St. Joseph County, Indiana. Ryan was elected to the Indiana House of Representatives in 2002. He became chairman of the Committee on Courts and Criminal Code in 2003. Currently, Representative Dvorak serves as chairman of the Environmental Affairs Committee, and serves as a member of the Commerce, Energy, and Utilities Committee, the Courts and Criminal Code Committee, and the Judiciary Committee.
Ryan is also a 2008 J.D. candidate from the Indiana University School of Law–Indianapolis.

Moderator Eric Dannenmaier is a Professor of Law at Indiana University School of Law in Indianapolis.* He is an expert in environmental law and policy, widely published on issues including environmental democracy, trade and the environment, and climate change. Andrea Palm is Senator Hillary Clinton's Senior Health Policy Advisor. She is traveling to Indiana next week speaking with and taking questions from students, staff, and faculty at a number of schools about the Senator's Presidential healthcare platform.
Andrea Palm serves as the health policy advisor to Senator Hillary Rodham Clinton (D-NY), who sits on the Health, Education, Labor and Pensions committee. She handles the Senator’s health committee work as well as her health agenda more broadly. A primary focus of her recent work has been on the implementation of the Medicare prescription drug benefit and addressing policy issues raised through this process, as well as Health IT and quality legislation which passed the Senate in November 2005.
Prior to joining Senator Clinton’s staff, Andrea served as Legislative Director to the late Congressmen Robert T. Matsui of Sacramento, CA. She handled Rep. Matsui’s Ways and Means committee issues, including health care and Social Security. She has also done a variety of low-income policy and direct service work for both non-profits and local government.
Andrea is a native New Yorker and received her undergraduate degree from Cornell University in Ithaca, NY. She has an MSW from Washington University in St. Louis.

Tuesday, April 8, at 5:00 p.m. Williams v. Tharp
Two men went to a Papa John's restaurant in Westfield to pick up a pizza they had ordered. An employee falsely reported one of the men pulled a gun. A number of police officers surrounded the men's vehicle when they returned home with the pizza. Police detained the men, in handcuffs and on their knees, for an hour and a half while they investigated.
The men sued Papa John's and its employee for defamation, false imprisonment, negligence, and intentional infliction of emotional distress. The trial court excluded evidence the men offered in the form of the police in-car video recording and some statements by a police officer. It then granted summary judgment for Papa John's and the employee on the grounds the complaint included no defamatory statement; the employee's statement was privileged; and the employee did not act intentionally or in an extreme and outrageous manner.

The Indiana Law Review is pleased to announce its plans to host a Symposium in celebration of the 40th anniversary of the passage of the federal Fair Housing Act. The Symposium will be held at the Indiana University School of Law - Indianapolis in the Wynne Courtroom. The Symposium is being developed with the counsel of Florence Wagman Roisman, William F. Harvey Professor of Law, and the faculty advisor to the Indiana Law Review, R. George Wright, Lawrence A. Jegen III Professor of Law.
The event will commence with a keynote address on the evening of April 3, 2008, by Theodore M. Shaw, Esq., Director-Counsel and President of the NAACP Legal Defense and Educational Fund, Inc (pictured above). The keynote address topic is "The Place of Race in Post-Affirmative Action America." A reception will follow the keynote address.
The Symposium will be held on April 4, 2008, which marks the passage of four decades since the tragic assassination of Dr. Martin Luther King, Jr. Dr. King's inspiring message of equal opportunity for every person and his commitment to changing views and attitudes are embodied in the Fair Housing Act. The Symposium will pay a special tribute to Dr. King and will honor his legacy through collaborative efforts to continue the eradication of housing discrimination and segregation. The tribute will be offered by Professor Monroe H. Little, Jr., Director of the African American & African Diaspora Studies Program and Associate Professor of History at Indiana University - Purdue University Indianapolis.

The Indiana Court of Appeals will hold oral argument in the Wynne Courtroom. The arguments are open to the public and the entire law school community. The judges will take questions from the audience after each argument.

A panel of Judge Ezra H. Friedlander, Judge Margret G. Robb, and Judge Paul D. Mathias will hear the case on appeal from Blackford Superior Court. The Court is asked to decide whether the trial court erred in finding that a statute limiting convicted sex offenders from living within 1,000 feet of a school property, a youth program center, or a public park was an ex post facto law as it applied to Mr. Pollard’s 20-year residency and was therefore unconstitutional in his case. Arguing for the appellant, the State of Indiana, will be Deputy Attorney General Cynthia Ploughe. Professor Linda Kelly Hill joined the faculty in the fall of 2002, following seven years as a faculty member at St. Thomas University School of Law in Miami, Florida. Professor Kelly Hill has written extensively on issues surrounding immigration law as well as domestic violence and the treatment of domestic violence in immigration law.
She worked as a staff attorney for the Haitian Refugee Center in Miami from 1992-1995. She has also served as a staff attorney for the Family Legal Services and Domestic Violence Unit of the Seventeenth Judicial Circuit in and for Broward County, Florida. She received her B.A. (1988) and J.D. (1992) from the University of Virginia. She teaches family law, immigration law, trusts and estates, and conflict of laws.

Margaret H. Marshall is the Chief Justice of the Supreme Judicial Court of Massachusetts. Appointed to her position in 1999, she is the first woman to serve as Chief Justice, and the second woman appointed to serve as an Associate Justice of that court.
Born and raised in South Africa, Chief Justice Marshall obtained her B.A. in 1966 from the University of the Witwatersrand in Johannesburg. While an undergraduate, she was elected president of the National Union of South African Students, at the time a leading anti-apartheid organization. She came to the United States to pursue her master’s degree at Harvard. Later, she was unable to return to South Africa because of her activities opposing apartheid.
She received a master’s degree in education from Harvard in 1969 and a J.D. from Yale Law School in 1976. Following graduation, she practiced law for sixteen years in Boston, becoming a partner in the Boston firm of Choate, Hall & Stewart. She became a U.S. citizen in 1978, and in 1992 was the first woman to be appointed Vice President and General Counsel of Harvard University. She was first appointed to the bench in 1996.
Chief Justice Marshall serves on the Boards of the Conference of Chief Justices and the National Center for State Courts. Before her appointment to the Supreme Judicial Court, she served as President of the Boston Bar Association and was a member of the Lawyers’ Committee for Civil Rights Under Law, both in Massachusetts and nationally. She was a trustee of The Africa Fund, a member of the board of Africa News, and serves as a trustee of Southern Africa Legal Services Foundation. In 1999, Chief Justice Marshall was elected to the Council of the American Law Institute. She has served on numerous other civic and charitable boards.

Antonio García-Padilla, a native of Coamo, Puerto Rico, received his B.B.A. degree in 1974 and his J.D. in 1978 from the University of Puerto Rico. He received his LL.M. from Yale Law School in 1981. García-Padilla served as law clerk to Judge Angel M. Martin of the Supreme Court of Puerto Rico, and to current United States Supreme Court Justice Stephen G. Breyer, then a judge on the United States Court of Appeals for the First Circuit. He returned to work as an Assistant Professor at the University of Puerto Rico Law School and as an assistant to the Chief Justice of Puerto Rico. He also served as Assistant for Federal Affairs to the Governor of the Commonwealth. He was named Associate Dean of the law school in 1983, and Dean in 1986. He has taught courses on civil procedure and commercial law, as well as general introduction to law. During his tenure at the law school, he created exchange programs, oversaw a thorough curricular revision, and oversaw the modernization of the library. In 1998, he was elected to the Council of the American Law Institute. From 1999 to 2001 he was a member of the University of Puerto Rico’s Centennial Commission. He is currently a member of the Editorial Board of In-forma, a new architectural magazine that has already won two prizes for design. He was appointed the eighth President of the University of Puerto Rico in November 2001.
The James P. White Lecture on Legal Education was created upon the occasion of Professor White’s retirement as Consultant on Legal Education to the American Bar Association (ABA) in 2000. He held the Consultant’s position with the ABA for more than 25 years. Members of the ABA’s Section of Legal Education and Admissions to the Bar and other friends contributed to the establishment of an annual lecture in his honor at the law school, where he has served on the faculty since 1966.

Shakespeare in the Courtroom: The Nature of Justice and the Art of Anti-Semitism
On Tuesday, February 26, at 5:30 pm, the touring arm of The American Shakespeare Center (ASC) will perform the courtroom scene from A Merchant of Venice in the IU School of Law School’s Wynne Courtroom. The performance will be followed by a discussion featuring distinguished professors and activists who will react to the scene, and then take questions from the audience.
The courtroom scene includes Portia’s speech “The quality of mercy is not strained” (which she delivers dressed as a young male lawyer). It is Shakespeare’s most sustained exploration of the nature of justice and law, as well as one of the most infamous and influential works of art in the history of anti-Semitism. Despite Portia’s rhetoric, Shylock is given little, if any mercy. As a Jew in Christian Venice, relegated to a ghetto by night and barred from most economic pursuits, Shylock lends money at interest to Christians – a practice that Church law prohibits for Christians. A Christian merchant, Antonio, reviles Jewish lenders even as he requires their services for his trade. This event will explore the relationship between law and justice, anti-Semitism and Jewish-Christian relations, gender, debt and capitalism… Even after 400 years, these issues resonate with contemporary audiences! The panel will be moderated by Robert Katz, Professor of Law and Philanthropic Studies. This event is co-sponsored by the Jewish Law Society, a student organization at IU School of Law – Indianapolis and the Department of English in the IU School of Liberal Arts at IUPUI. Alan was also an English major as an undergraduate, and graduated from IU Law-Indy.

Alex M. Azar II joined Eli Lilly and Company June 2007 as senior vice president of corporate affairs and communications. He is a member of the company’s policy and strategy committee and its operations committee.
Azar received a bachelor degree summa cum laude with highest honors in government and economics from Dartmouth College in 1988. He earned his law degree at the Yale Law School in 1991, where he served as a member of the executive committee of the Yale Law Journal. He clerked for Judge J. Michael Luttig of the U.S. Court of Appeals for the Fourth Circuit and for Associate Justice Antonin Scalia of the Supreme Court of the United States. Azar worked as an associate independent counsel for the first two years of the Whitewater investigation and was a partner at Wiley, Rein & Fielding in Washington, D.C.
From 2005 to 2007, Azar served as Deputy Secretary of the U.S. Department of Health and Human Services, where he was the number two official and chief operating officer for the largest civilian cabinet department in the U.S. government, with a budget of $698 billion and over 66,000 employees reporting up to him. On behalf of the Secretary, he oversaw all HHS programs and operations, including Medicare, Medicaid, public health, medical research, the regulation of food and drugs, public health emergency preparedness and response, and many other activities. From 2001 to 2005, he served HHS as General Counsel.
Azar has extensive global health diplomacy and international experience, including leading U.S. government efforts to encourage worldwide pharmaceutical and medical device innovation. He also served as the U.S. Co-Chair of the U.S.-E.U. Summit on Prevention and was a member of the U.S.-Ireland Research and Development Steering Committee.
Azar is a recipient of the Surgeon General’s Medallion, the highest medal awarded to civilians by the U.S. Public Health Service Commissioned Corps.

In 1989 he completed doctoral studies in Roman law, defending his thesis “Criminal law regulations of the Roman Christian Emperors in religious matters”. His habilitation degree was awarded in 1996 based on the book “Sacrilege in Roman Law”. He was a research fellow at the Polish Institute in Paris, Université Catholique de Louvain (UCL) and the Katholieke Universiteit Leuven. He serves as Editor-in-Chief of the journal “Studia Prawnicze KUL” (KUL Legal Studies). He graduated from Whitworth College in Spokane, Washington where he received a double degree (B.A.) in History/Political Science and Theatre Arts. He received his Juris Doctorate (J.D.) degree from the National Law Center of George Washington University in Washington D.C in 1990. He worked for over 10 years as a trial attorney in the United States specializing in taking criminal and civil cases to court, with an emphasis on jury trials. In 1994 he was recognized as the outstanding Young Lawyer of the Year for the State of Washington.
From 1997-99 he worked as the Rule of Law/Criminal Law Liaison for the American Bar Association’s Central Europe and Eurasia Law Initiative (CEELI) legal reform program in Poland. As liaison he worked closely with Iustitia, the Polish Judges Association, the Ministry of Justice and lawyers groups on legal reform and judicial training and was a founder of Catholic University’s Center for American Law. From 1999 to 2002 Professor Swenson managed CEELI’s legal reform programs in the five Central Asian Republics of Kazakhstan, Krygzystan, Uzbekistan, Tajikistan and Turkmenistan. As Regional Director he was administrative and programmatic manager of a multi-million dollar legal reform assistance program with 10 offices in five countries.
In 2002 he was a Senior Scholar with the United States Fulbright Program in Poland. He is a founder and Council Member of the Polish Rule of Law Institute Foundation. He continues to work on legal reform projects, and has consulted on projects for the Organization for Security and Cooperation in Europe (OSCE), the United Nations, USAID and the State Department. He is presently involved as an expert and trainer in a State Department funded Model Courthouse project run by Indiana University in China and a legal reform project with Freedom House in Kyrgyzstan.
Professor Swenson has provided training on adult education methods, trial advocacy, human rights, court and judicial reform in the United States, Central and Eastern Europe, Asia, and the Newly Independent States of the former Soviet Union.

The Program on Law and State Government sponsors the course entitled "Public Policy Mediation within State Government" for the Spring Semester, January 7-11, 2008. This two (2) credit course will offer law students mediation training, instruction on substantive aspects of public policy mediation in the state government setting, and the opportunity to participate in the mediation process with an experienced mediator.
The course is open to non-students as well. It will be of particular interest to practicing attorneys, municipal and state lawyers, judges and professionals in all public policy fields. Attorneys receive 24.0 CLE credits in addition to the 40-hour Civil Mediation training certification.

Halima Taha is recognized throughout the United States as a leading authority on African American art and arts management. For more than twenty years, she has contributed to the field as an appraiser, art advisor, educator and lecturer. Author of the best selling book Collecting African American Art Works on Paper and Canvas (Random House, January 1999, Verve Editions, 2005),and Three Decades of American Printmaking: The Brandywine Collection (Hudson Hills Press, October 2004), she has been featured in USA Today and on television on Fox News and Good Day New York. Her experience includes her leadership as an arts advocate and spokesperson, lecturer, and art gallery owner specializing in 20th Century art and photography. A former member of the faculty of the College of New Rochelle, she is listed in the Annual Yearbook of Experts, Authorities and Spokespersons. Halima Taha is currently president of halima ink, a professional arts and education company. She is also a member of ArtTable, Inc., the National Association of Female Executives, the College Art Association, and the African American Museum Association. The Jordan H. and Joan R. Leibman Forum was established at IUPUI in 2004 to examine issues on the legal and business environment of the arts, and is a joint project of the IU Kelley School of Business Indianapolis, the IU School of Law-Indianapolis and the IU Herron School of Art and Design.

For the past 27 years, Ken Paulson has drawn on his background as both a journalist and lawyer, serving as the editor or managing editor of newspapers in five different states and in recent years as the executive director of the First Amendment Center at Vanderbilt University. Ken was on the team of journalists who founded USA TODAY in 1982. He’s widely known for his efforts to inform and educate Americans about First Amendment freedoms and as a strong voice for tougher confidential sourcing policies and ethics guidelines in America’s newsrooms.

Adjunct Professor Major Dan Mori, Chief Defense Counsel to David Hicks, the Australian citizen convicted at Guantanamo Bay. Major Mori has been U.S. Marine Corps (18 years) in posts including Special Ass't U.S. Attorney & Senior Defense Counsel, Military Justice Office in Hawaii, Japan & South Carolina.
In November '03, the Pentagon appointed Major Mori to represent David Hicks, an Australian citizen, before a Guantanamo Bay military commission. In August '04—Hicks' proceedings marked 1st U.S. Military Commission since World War II. Proceedings suspended & rescheduled for '05. The U.S. Supreme Court ruled Military Commissions "illegal" (summer '06). Congress enacted new legislation and Hicks faced a new Commission in March '07. Mori was chief defense counsel when Hicks pleaded guilty, marking the first Military Commission conviction since WW II.
Major Mori was a graduate of Norwich University, Northfield, Vermont & Western New England School of Law, Springfield, Massachusetts. "Prisoners of Isolation: The Psychological and Legal Implications of 'Supermax' Confinement"

This event is free and open to the public.
Craig Haney’s research concerns the application of social psychological principles and data to various legal and civil rights issues. He has specialized in the assessment of institutional environments, especially the psychological effects of incarceration, as well as the study of the social histories of persons accused or convicted of serious violent crimes. He has also studied the way in which attitudes and beliefs about crime and punishment are changed by legal procedures, as well as the role such attitudes and beliefs play in influencing legal fairness and impartiality.
Haney and his students are currently involved in a wide range of research projects including examining criminogenic social histories, the psychological effects of different forms of incarceration, the role of pre-trial publicity in creating juror prejudice and prejudgment, and the structure of criminal justice attitudes and the mechanisms that underlie discriminatory legal decision making.
Professor Haney received his B.A. degree from the University of Pennsylvania and later earned an M.A., J.D. and Ph.D. from Stanford. He is a recipient of the Herbert Jacobs Prize for Most Outstanding Book published on law and society in 2005 for Death by Design, and has been nominated for a National Book Award for Reforming Punishment.

The Program on Law and State Government sponsors the course entitled "Public Policy Mediation within State Government" for the Fall Semester, August 13-17, 2007. This two (2) credit course will offer law students mediation training, instruction on substantive aspects of public policy mediation in the state government setting, and the opportunity to participate in the mediation process with an experienced mediator.
The course is open to non-students as well. It will be of particular interest to practicing attorneys, municipal and state lawyers, judges and professionals in all public policy fields. Attorneys receive 24.0 CLE credits in addition to the 40-hour Civil Mediation training certification.

Magliocca gave a talk at the George Washington University Law School on April 5, discussing his new book on a critical period of American history, Andrew Jackson and the Constitution: The Rise and Fall of Generational Regimes (University Press of Kansas).
