     Greetings to all. We hope this year's first e-newsletter finds you well. We invite you to read the excellent essays that have been incorporated into this newsletter as well as see the upcoming and past events of the Hall Center. 

     Just to update you on our activities, Dr. David Orentlicher has been busy writing an article entitled: "Presumed Consent to Organ Donation: Its Rise and Fall in the United States," 61(2) Rutgers Law Review (forthcoming Winter 2009). He has given several presentations over the summer including traveling to Philadelphia to speak on the subject of his article. Professor Eleanor Kinney has also been busy writing several articles and giving presentations. Most recently she was involved in the Emergency Preparedness Conference at the Marion County Health and Hospital Corporation as a moderator.

Obama v. McCain

     The struggle between presidential hopefuls John McCain and Barack Obama has been deemed a derisive head-to-head battle between polar opposites, an idea that truly manifests itself in the candidates' proposed health care programs.  On the one hand, McCain has drafted a market-based approach, relying on economic factors to provide greater health care options.  Obama, on the other hand, utilizes the government in his fight to provide health care for all Americans.  Read more...

     Periodically, a new technology comes along with the potential to reshape society.  Transistors, microelectronics, biotechnology, and computer-based information systems are just a few examples.  Nanotechnology presents this same or greater potential.  Pundits estimate that nanotechnology-based products will account for trillions of dollars in sales in only a few years.  Yet, in order to achieve its promise, nanotechnology must address a plethora of new and unusual legal, social, and ethical issues that are just now starting to be explored.  Read more...

     Last year, the Center for Medicare and Medicaid Services (CMS) took a leading role in its move toward pay for performance when promulgating the FY2008 Inpatient Prospective Payment System (IPPS) final rule, which listed eight medical conditions to be denied reimbursement if acquired during a patient's hospital stay.  Read more...

     In May 2008, the Hall Center for Law and Health ("Hall Center") at Indiana University School of Law-Indianapolis created the Hall Center for Law and Health Alumni Steering Committee ("Steering Committee").  The Hall Center is currently comprised of three student organizations: the Health Law Society, the Indiana Health Law Review, and the Health E-Newsletter.  The Steering Committee has been organized to provide advice and suggestions to the Hall Center's leadership and organizations in order to further their relevance to legal professionals.  Read more...

     The Hall Center for Law and Health at the Indiana University School of Law-Indianapolis is hosting Professor Halit Yilmaz from the law faculty at Akdeniz University in Antalya, Turkey. Professor Yilmaz will be a visiting fellow at the Hall Center during the 2008-09 academic year.   Read more...

     A Gubernatorial Forum was held Monday, October 13 in the Lilly Auditorium of IUPUI's University Library's and featured representatives for each major-party candidate presenting details of their respective candidates' plans. Indiana State Senator Patrica Miller represented Republican Governor Mitch Daniels, and Indiana State Representative, Professor David Orentlicher, M.D. presented on behalf of Democrat Jill Long Thompson. Libertarian candidate Andy Horning represented himself. Each representative presented their candidate's health care platform and answered questions from a panel of students. State Health Department Reports Third Human Case of West Nile Virus
     INDIANAPOLIS ­- State health officials report one probable human case of West Nile virus in Marion County.  This is the third human case of West Nile virus infection in Indiana this year.  The other human cases were in Perry and Tippecanoe counties.  West Nile virus is transmitted to humans by mosquitoes that have first bitten an infected bird. A person bitten by an infected mosquito may show symptoms from three to 15 days after the bite.  Health officials say although individuals age 50 and over are at greatest risk for serious illness and possibly death from the West Nile virus, people of all ages have been infected with the virus and have had severe health problems.  For more information, visit the Indiana State Department of Health Web site at: www.statehealth.IN.gov.
